David Joanisse focuses his practice on civil and commercial litigation, especially in matters related to shareholder disputes, breaches of contract and product liability. His clients include manufacturing, retail, high tech, real estate and public services companies.

Mr. Joanisse is also frequently called upon to address issues related to administrative law, disciplinary law, construction law and class actions. He has appeared before all levels of courts and has solid experience before appellate courts. He has also led many applications for provisional remedies such as injunctions, safeguard orders, Anton Piller orders, and seizures before judgment.

He is highly involved in the cultural sector, and has been a long-time director of several non-profit organizations.

Representative Work

Mr. Joanisse’s clients include corporations such as Xerox Canada, Garda and Neptune Technologies, as well as public entities such as the city of Saint-Eustache and the Agence Métropolitaine de transport, Greater Montreal’s public transit commission.

Mr. Joanisse has represented his clients in the following capacities:

Representing majority and minority shareholders in numerous oppression remedy actions before Quebec courts.

Defending several corporations against oppression remedy actions before Quebec courts.

Representing various corporations and individuals before arbitration tribunals in Quebec.

Representing art galleries against claims for damages and in intellectual property matters.

Representing heirs and liquidators in estate litigation involving steps such as applications for the removal of a liquidator, contesting a will and injunctions.

Defending various professionals, including engineers and architects, in hearings before the discipline committees of their professional orders.

Recognition

  • Mr. Joanisse was awarded the Right Honourable Brian Dickson Prize from the Civil Law Section of the Faculty of Law at the University of Ottawa for his excellent academic standing during his studies, in both civil and common law.
